With its declaration on the “Klimaseniorinnen” judgment, the Federal Assembly is attacking the very heart of the European human rights system. It also questions the competence of the courts to apply human rights to the biggest challenges of our time. It is now up to the Federal Council to limit the damage and reaffirm the binding nature of judgments by the European Court of Human Rights.
